Man Wrongly Jailed on Heroin Possession Charge

A 36-year-old suspect spent three weeks in the Rockland County jail on afelony charge of possessing 1.35 kilos of heroin after multiple packages of white powder were found inside shopping bags that were in his possession.
But, based on the test results, his defense attorney wanted the felony indictment on the drug charge dismissed because the substance turned out to be a cutting agent usually mixed with heroin and not heroin at all. The suspect allegedly told police that the substance was rat poison.
Rockland County Court Judge released Bueno without bail on the drug charge but was still being held on an immigration detainer pending charges of being in the United States illegally.
