Judge Orders DWI Retrial Due to Possible Lab Errors

A judge ordered a new trial for a woman who was convicted of DWI because of supposed mistakes at the lab with drug analysis and because some blood-alcohol testing samples may have been mislabeled. Prosecutors said last week that paperwork errors happened in 9 blood-alcohol tests in DWI cases on one day last fall. And the wrong test results were attached to some defendants' files.
Defense attorneys state that this could mean new trials for those convicted of DWI.
The woman who was found guilty of aggravated vehicular assault and DWI in August 2010 has a preliminary date of March 21 for a new trial.
