A Lake Grove man was arrested for allegedly DWI on the Long Island Expressway with his two sons inside the vehicle on Sunday afternoon.
A Suffolk County deputy sheriff pulled the 31-year-old over near Exit 64 in Medford. That's when he reportedly told the deputy that he had been drinking during a fishing trip and he and the boys (ages 7 and 8) were returning home, according to the sheriff's office.
The driver was then charged with DWI, a felony under Leandra's Law. He was also charged with endangering the welfare of a child and unsafely changing lanes.
He refused a breathalyzer test, sheriffs said. Blood test results are pending. The children were then released to their mother.
Whelan will be arraigned Monday at First District Court in Central Islip.
