Mr. Schuster believes in the necessity to remain current with legal developments
and new laws that govern our state. On November 8, 2009, New York passed
a new law regarding DWI and children in the car at the time of arrest.
According to
NY VAT §1192-2a(b), also known as
Leandra's Law, it is a first-degree felony to operate a motor vehicle while intoxicated
and while there is a child under the age of 15 in the vehicle at the time
of your arrest.
Another recent development is the
New York "move-over" law, which was revised and went into effect as of January 1, 2012. This law,
NY VAT §1144-a, requires that drivers exercise due care when passing an emergency vehicle
displaying amber lights on the side of the road. "Due care"
can include slowing down to pass the emergency vehicle, and the law mandates
that vehicles change lanes out of the immediate adjacent lane when traffic
and other hazards permit.
Drunk driving has spurred many various proposals regarding amendments to
New York state law in order to minimize repeat offenses. One example of
a bill that was passed by the senate early in 2012 is Tiffany's Law,
which would link all prior operating while intoxicated offenses. This
means that if you were convicted of DWI in a car, then a boating while
intoxicated charge would count as a second conviction under the new law.
Another legal matter regarding safety on the road is texting and driving.
There have been recent proposals throughout the United States as well
as in the state of New York to increase penalties and place stricter bans
on texting and driving. Mr. Schuster can take on any traffic offense case
